DigiQ's Report on Notice and Action mechanism under Article 16 of the Digital Services Act (DSA)

We are pleased to present DigiQ’s latest monitoring report on the Notice and Action mechanism under Article 16 of the Digital Services Act (DSA). The report analyses how Very Large Online Platforms (VLOPs) respond to user notifications of illegal hate speech in Slovakia and is available in English.

The monitoring exercise identifies limitations in compliance that raise concerns regarding both the effectiveness of reporting mechanisms for users and the transparency of platform procedures. The findings indicate notable differences in platform performance. While TikTok demonstrated comparatively higher responsiveness and more timely feedback, Meta platforms showed significant limitations. Facebook removed 6.1% of the reported content and Instagram 12.1%, with none of the Meta submissions reviewed or removed within 24 hours and feedback absent in the majority of Facebook cases.

The analysis was conducted prior to the European Commission’s monitoring exercise on illegal hate speech and provides a reference point for understanding whether VLOPs adjust their monitoring practices under anticipated regulatory oversight and how content moderation varies across EU Member States.
